This project explores the requirement of generality, a principle stating that legislation must be of general application. The principle has gained attention in several high-profile cases recently, including the Talma Case (Svea Court of Appeal, judgment 2019-12-20, case no. T 7463-18) and 'Lex Cementa' (HFD 2022 ref. 50).
The thesis aims to clarify the scope and development of the principle, its historical evolution and its role in maintaining the separation of powers. By looking at how legislators, courts, and authorities interpret the rule, the project shows how different viewpoints have emerged and what that means for our legal system.
The research intends to contribute to a clearer, more consistent understanding of the requirement of generality in Swedish law. This is important for ensuring predictability, rule of law and legitimacy within the legislative process. Ultimately, it is about protecting the rights of citizens and upholding a stable constitutional order.
